The Need for a Legal Framework in Nigeria’s Digital Transformation
Prof. Olubukola Olugasa, a Professor of Law and Technology at Babcock University, has called for the creation of a strong legal framework that can effectively balance technological advancement with societal responsibility. His focus is on ensuring that Nigeria’s digital governance and security are strengthened through the consolidation of national data.
During the 59th inaugural lecture of the university, titled “The Quest for Return to Eden: Balancing Technological Acceleration with Legal Safeguards for Long-term Societal Responsibility,” Prof. Olugasa highlighted the importance of legal safeguards in managing the rapid pace of technological innovation. He emphasized that without clear laws, technology could outpace ethical considerations and accountability.
He pointed out that data sovereignty is a crucial component of national security and economic independence in the digital era. Prof. Olugasa suggested that Nigeria should develop an exclusive broadband infrastructure similar to the achievements of Dangote’s refinery. This would help in maintaining control over the country’s digital resources and ensuring that they align with national interests.
Integrating Law and Technology for Better Governance
The professor also discussed the importance of integrating law and technology to improve planning, security, and transparency. One example he cited was the Bimodal Voter Accreditation System (BVAS), which verifies voters, supports electronic voting, and uploads results to the IReV portal for real-time public viewing.
Prof. Olugasa warned that Nigeria and other countries in the Global South should not simply follow the technological paths set by Western nations. Instead, he advocated for innovative solutions that are culturally appropriate. He argued that technology has often perpetuated colonial structures, but collaboration among nations could lead to more resilient and equitable models for digital integration.
Strengthening Energy Capacity and Legal Frameworks
In addition to focusing on digital governance, Prof. Olugasa stressed the need to enhance energy capacity by integrating various sources into the national grid. This would require legal frameworks and constitutional amendments to recognize and integrate indigenous laws. He also pointed out the necessity of updating existing legislation to meet the demands of digital governance.
Furthermore, he mentioned the need for laws regulating agriculture to improve yields through natural farming methods while limiting the use of genetically modified foods. He also called for legislation to reduce the indiscriminate use of paper in transactions and correspondence.

Prof. Olugasa concluded his lecture by urging Nigeria to take its own path in technological development. He emphasized that the country, along with the entire Global South, should not merely follow the Western technological pathways but instead create innovative alternatives that suit their unique needs and circumstances.
This approach would ensure that Nigeria’s technological growth is sustainable, inclusive, and aligned with the values and traditions of its people. By developing its own digital infrastructure and legal frameworks, Nigeria can position itself as a leader in the digital transformation of the Global South.
